SC disposes of appeals related to Tosha Khana case

Islamabad: Supreme Court of Pakistan Friday disposed of the appeals against former Prime Minister Imran Khan related to Tosha Khana case.

According to details, a three-member bench of Supreme Court said in its verdict that the trial court cannot decide Tosha Khana case until the final verdict of Islamabad High Court (IHC).

During the hearing, Supreme Court asked PTI's counsel whether High Court had issued an injunction, to which Khawaja Haris said no, the decision is reserved.

The Supreme Court disposed of the petition of Chairman Tehreek-e-Insaf on the basis of withdrawal.

The court said: “High Court and the trial court are expected to follow the spirit of the law, pending the transfer of the case in the High Court”.

Justice Yahya Afridi said the trial court cannot decide on the case transfer appeal. While Advocate Election Commission Amjad Parvez took the position that Section 528 of the Criminal Code is clear in this regard.

Yahya Afridi stated: “The matter has gone beyond the law and has come to the consent of the parties”. Responding to which Amjad Pervez said, ‘If I express my consent, Mr. Khawaja interprets it wrongly’.

The order of Supreme Court will not affect the other pending petitions of Chairman Tehreek-e-Insaf, court added.

Supreme Court had issued a new cause list regarding Tosha Khana case, in which it was stated that Justice Hasan Azhar Rizvi has been included in the bench in place of Justice Mazahar Ali Naqvi.

The lawyers of PTI chief Imran Khan informed the court about the High Court hearing.

Supreme Court said in the order of previous hearing that the next hearing will be conducted by an available bench.
