SC declares Review of Judgments and Orders Act unconstitutional

Islamabad: The three-member bench of the Supreme Court, under the leadership of the Chief Justice, has declared the Review of Judgments and Orders Act 2023 unconstitutional.

The Court emphasized that the Act lacks legal standing, and decisions made under it, including the upcoming Punjab election review case, will not be considered by the former bench.

The decision was read by Chief Justice Umar Ata Bandial after determining the eligibility of the requests for consideration.

The Court's verdict asserted that the Review of Judgments Act is non-constitutional, thus rendering the act ineffective for future legal proceedings, including the previous bench's review of the Punjab election case.

The three-member bench, presided over by the Chief Justice, delivered the ruling, which further upheld the earlier decision on June 19th, securing the significance of the judgment.

The Parliament had previously enacted the Review of Judgments and Orders Act 2023, granting the right of judicial review before a larger bench.

However, this latest ruling by the Supreme Court questions the constitutionality of the Act and its application in legal appeals.
