PHC orders to provide certified documents of election results to PTI
The court disposed of the petitions ordering the Election Commission to provide the certified documents of the results to the petitioners.
Peshawar: The Peshawar High Court (PHC) Thursday ordered Election Commission of Pakistan (ECP) to provide certified documents of election results to Pakistan Tehreek-e-Insaf (PTI) leaders.
According to the details, a two-member bench comprising Justice Shakeel Ahmad and Justice Arshad Ali of the PHC heard the petitions of PTI leaders, including Taimur Jhagra, Kamran Bangash and others, for the provision of election result documents.
During the hearing, the petitioner's lawyer said that it is the responsibility of the Election Commission to provide the attested documents to the candidate as it is their right.
Justice Syed Arshad Ali asked the lawyer of the ECP that who will provide the certified copy to the petitioners, to which he replied that applicants can also take documents from Returning Officers (ROs), apply there.
Justice Shakeel Ahmed stated that according to the Election Rules, the ECP mentions that the documents will be provided by the Commission. The petitioner's lawyer also said in the court that Rule-91 says that the ECP will provide certified documents.
Election Commission's counsel told the court that when they got Forms-45 and Forms-47, they uploaded them. The applicants can get the forms from Election Commission's website. The action is underway against ROs who have not submitted the forms within 14 days.
The petitioner's lawyer said that it is feared that Form-45 and Form-47 are being forged daily. On this Justice Shakeel answered that if they give you the certified form, then how will they change it as it will be with you.
Later, the court disposed of the petitions ordering the Election Commission to provide the certified documents of the results to the petitioners.
