26th Amendment: Interesting remarks by Justice Mansoor, Justice Ayesha
Justice Ayesha Malik remarked, ‘Now you know and your constitutional bench knows’.
Islamabad: Justice Mansoor Ali Shah and Justice Ayesha Malik of the Supreme Court gave interesting remarks regarding the 26th constitutional amendment approved by the Senate and the National Assembly.
During the hearing on the case related to the establishment of the Climate Change Authority, Justice Mansoor Ali Shah had an interesting conversation with the Additional Attorney General.
Justice Mansoor Ali Shah inquired whether the notification of the climate change chairman had been issued. To which the Additional Attorney General replied that the notification had not been issued yet.
Justice Mansoor asked about the Attorney General Mansoor Usman Awan. The Additional Attorney General replied that the Attorney General was busy last night and that is why he did not come. Justice Mansoor smiled and said that now all the busyness is over, he should appear at the next hearing and adjourned the hearing of the case for two weeks.
Appeal relating to Competition Commission
Justice Mansoor Ali Shah mentioned the Constitution Bench during the hearing on the appeal against the High Court's decision regarding the Competition Commission.
Justice Mansoor smilingly asked whether this case would go to the constitution bench or if they could also hear it. Now it seems that the question will arise every day in the Supreme Court whether the case will be heard by a general bench or a constitutional bench.
Lawyer Farogh Naseem said that political cases have now become constitutional cases. On which Justice Ayesha Malik remarked with a smile, ‘Now you know and your constitutional bench knows’.
Justice Mansoor Ali Shah remarked with a smile that they are adjourning the hearing of the case for three weeks, by which the situation will be clear, however, it will take some time for us to understand ourselves.
Justice Ayesha Malik remarked that read the new amendment, article 199 case cannot be heard here.
