He further said that an inquiry was headed by the Chief Justice, the Constitution requires unconditional loyalty to the state.


Islamabad: The caretaker prime minister Anwaar-ul-Haq Kakar has appeared in Islamabad High Court (IHC) in missing Baloch students’ case.
According to the details, justice Mohsin Akhtar Kiyani heard the case in IHC.
Attorney General Mansoor Usman Awan came to the rostrum and stated that the struggles have been made in recovering the missing Baloch students’ case.
He said that the 11 more missing Baloch students have recovered and 9 are in the custody of Counter Terrorism department (CTD) and 4 of the students have not traced yet and 2 of them are in Afghanistan.
Justice Mohsin remarked that those who legally processed are out of the court’s mandate now. If they have cases then the relevant courts will deal with them.
He said that he heard many hearings in two years that the Baloch students picked up, some people are terrorist, some joined Tehreek-e-Taliban Pakistan (TTP) and some reached homes.
Mohsin affirmed that the state’s institution must also work and be accountable for that. If this case is heard then from the departments’ struggles people reached their homes. The departments are not superior from law.
If anyone should be arrested then the relevant information about his arrest will be given to the court because if the people got missing then the allegations are being made on state, Justice added.
Anwaar-ul-Haq said that all are working under the constitution and law and he appeared amid summoned by the court. He belonged to Balochistan and he is facing the armed struggle.
He remarked that the stated considered itself superior in the context of courtesy that is why it is more accountable for whatever happens. The suicide bombers are not a good cause for the country.
Caretaker prime minister said that the allegations are imposed on para military forces and counter terrorism departments. If asked about the missing people then gave 5,000 names relevant to them.
He claimed that they are not interested in solving this issue and because of them considering the whole state as a criminal is not a right way. On costal highway some people were burned when they were taking breathes but no one remembered about the violation of human rights at that time.
There is not a solid proof of the crime and it is the lack of technology in country’s system so how can the governments punished someone without proof, Anwaar added.
Anwaar said that he was asked that how will he go back to Balochistan when 90 thousand people were martyred by terrorism and 90 people were not punished.
The court said that not once in 24 months has it been stated that someone is in the custody of CTD, it is the failure of the state agencies that they could not prosecute them, the law is flawed and there is no evidence to improve it. It is necessary, the law is the same, it has to be followed.
Caretaker prime minister pleaded from the court that the upcoming government should see these kinds of cases so that the state will be out of these kinds of allegations because state is responsible to protect the nation.
Justice Mohsin Akhtar Kiyani said that no court is asking to provide protection to non-state actors, there is undoubtedly a war, our army and institutions are fighting.
Anwaar said that England revoked the citizenship of a British woman who had gone to Syria and sent her back. Violations of non-stake actors are also recorded. A former Chief Justice of Balochistan was martyred by armed groups during evening prayers.
He further said that an inquiry was headed by the Chief Justice, the Constitution requires unconditional loyalty to the state.
