Advocate Samer stated that the Tribunal does not have any powers above the ECP to annul its any decision.


Lahore: The Lahore High Court (LHC) Tuesday reserved its decision on the admissibility of the petition filed by Pakistan Tehreek-e-Insaf (PTI) leader Salman Akram Raja against the victory of Aun Chaudhry from NA-128 in the general elections.
According to the details, Justice Ali Baqir Najafi heard the request of Salman Akram Raja.
At the beginning of the hearing, the lawyer for the petitioner, Advocate Samer Khosa, said: “I have come to the court against the decision of the Election Commission of Pakistan (ECP), I have no other option but to come to this court. The Election Commission referred the case to the Tribunal; however, it cannot make any observations”.
He stated that the Tribunal does not have any powers above the Election Commission, the Tribunal cannot annul any decision of the ECP.
The lawyer added that any petitioner can challenge the election in the Election Tribunal, but he cannot challenge any order of the Election Commission.
Advocate Sameer Khosa took the position that we had approached the ECP against the victory of Aun Chaudhry from constituency NA-128, the ECP said that you should file an application in the Election Tribunal, the Commission did not use its legal justification.
He requested that the court to annul the decision of Election Commission and annul the notification of victory of Aun Chaudhry from Constituency NA-128.
Later, the LHC reserved the decision on the admissibility of the petition filed by Salman Akram Raja against the success of Aun Chaudhry from NA-128 in the general elections.
It is pertinent to note that Salman Akram Raja had filed a petition against the success of Aun Chaudhry in the Lahore High Court the previous day.
Notably, in the general elections held on February 8, Aun Chaudhry defeated Salman Akram Raja, which was later challenged by Salman in the LHC on February 9. The court stopped the release of the results of this constituency.
Later, on February 15, the ECP withdrew the notification of the victory of Istehkam-e-Pakistan Party (IPP) leader Aun Chaudhry from constituency NA-128 Lahore.
However, on February 23, the ECP had issued a notification for the reinstatement of Aun from National Assembly Constituency NA-128.
