Govt should remove basic rights by changing constitution: IHC
Justice Aurangzeb stated federal government means prime minister and federal cabinet
Islamabad: The Islamabad High Court (IHC) Thursday remarked in the Pakistan Tehreek-e-Insaf (PTI) missing worker case that it is better to change the constitution and remove basic rights from it.
Justice Miangul Hassan Aurangzeb of IHC heard the request for the recovery of missing PTI activist Faizan, in which Additional Attorney General Munawar Iqbal Dogal appeared before the court.
Justice Aurangzeb expressed agitation in the dialogue with the Additional Attorney General and said that change the constitution, remove the fundamental rights from it, abolish our jurisdiction, and run the country just like this. ‘I don't know what the state is going to get from it. You arrest him, we won't say anything, but don't run the country like this’.
Justice Miangul Hassan said that the Ministry of Defense and the Ministry of Interior are all happy with this. I don't understand what is happening, or what do they want to achieve from it. The bench in which the case was before has written that it is a case of forced disappearance, it is a cruel act, what should the constitutional courts do in this situation? The world is watching what the Pakistani courts (missing persons) are doing in these cases, or else the world will invest here and people will be missing and the courts will not be able to do anything.
Justice Aurangzeb stated that the federal government means the prime minister and the federal cabinet and the responsibility ultimately falls on the executive head.
The public prosecutor said that the petitioners did not knock the door of the court with clean hands.
The court stated that because they did not apply with clean hands, should it be dismissed? Do you want me to become a serving judge? These are dirty applicants, we reject the application. I don't understand where you are taking us. Additional Attorney General, tell me what should I do. If the government calls it a case of enforced disappearance, see who it was at the behest of. The government needs to sit with the abductors on this issue.
Additional Attorney General said that we do not know who the kidnappers are.
Justice Aurangzeb added that one of our fellow judges gave a strict order, and then the government propaganda machines started propaganda against him, I will pass the order in this case.
