Decision on bail pleas made mandatory within five days
Special judge can decide on the bail according to the central policy mandate
Islamabad: The Islamabad High Court (IHC) issued a written decision on Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and Bushra Bibi's plea for early bail decision in the Toshakhana II case. Accordingly, a decision on bail must be made within five days.
Justice Miangul Hassan Aurangzeb issued a three-page reserved judgment in which it was stated that as per the National Judicial Policy, the Magistrate must decide on bail within three days and the Sessions Court within five days.
The court decision said that according to the National Judicial Policy, the High Court must decide on bail within seven days.
The IHC said that the time given for the session court will apply to the special court. The special judge can decide on the bail according to the central policy mandate.
After the court decision, the decision on the bail application of Imran Khan and Bushra Bibi is likely in the next five working days.
The judgment said that according to the petitioner, his bail application is being delayed without reason. The petitioner's lawyers requested to direct an early decision on the bail petitions.
The IHC stated in the judgment that the Federal Investigation Agency (FIA) took a stand that according to law the court will decide on the bail applications. After the case is transferred to the FIA, the bail applications are pending before the Special Judge Central.
