PTI eligible for reserved seats but not party before SC: Justice Yahya's dissenting note
Justice Yahya Afridi wrote that ECP should hear parties and decide within seven days


IslamaThe bad: Supreme Court judge Justice Yahya Afridi issued his dissenting note in the decision related to the case of the reserved seats.
Justice Yahya Afridi wrote a 26-page dissenting note stating that the Sunni Ittehad Council does not meet the constitutional requirements for securing the reserved seats and hence the petitions of the SIC are rejected.
In the dissenting note of Justice Yahya, it has been stated that PTI is a political party and is eligible for reserved, but PTI has not become a party before this court.
According to the disputed note, the case was going on from June 3 and PTI did not file any application till June 26. On June 26, PTI requested to become a party. Barrister Gohar Ali Khan applied for assistance in the ongoing case, but PTI did not seek any declaration in its favour.
Justice Yahya Afridi wrote that the Election Commission of Pakistan (ECP) should hear the parties and take a decision within seven days and review the notification of reserved seats.
It is pertinent to note that yesterday the majority judges of the Supreme Court issued a detailed judgment in the case related to reserved seats, in which the ECP was once again ordered to notify the candidates of PTI on reserved seats.
