PTI challenges 26th Constitutional Amendment in SC

Islamabad: Pakistan Tehreek-e-Insaf (PTI) has challenged the 26th Constitutional Amendment in the Supreme Court.

PTI has filed a petition in the Supreme Court through lawyer Sameer Khosa against the 26th Amendment, requesting that the amendment be declared null and void.

The petition has taken the position that Parliament cannot change the basic features of the Constitution. The independence of the judiciary is a fundamental part of the Constitution and no amendment can be made against the independence of the judiciary, therefore the constitutional amendment is against the constitutional principle of separation of powers.

In its petition, PTI has also requested to prevent the Judicial Commission from appointing judges until a decision is made on the 26th Constitutional Amendment.

It is pertinent to note that 15 petitions have been filed in the Supreme Court against the 26th Constitutional Amendment earlier.
