Islamabad: The charge sheet in the contempt of Election Commission of Pakistan (ECP) case could not be filed against Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan, Asad Umar and Fawad Chaudhry as none of the three appeared.
According to details, a four-member commission headed by Member Sindh Nisar Durrani heard the contempt of Election Commission and Chief Election Commissioner Case where none of the accused appeared.
The assistant counsel requested for an adjournment, on which the commission chief Nisar Durrani remarked if there are security concerns, they can order a hearing in jail. Interior Secretary said that they have no objection on hearing in jail.
The members of the commission asked whether the law allows this. On which the interior secretary took the position of seeking an opinion from the law ministry. When the commission asked, the lawyer said that Fawad Chaudhry is in Adiala jail in judicial custody.
PTI lawyer Shoaib Shaheen, while giving arguments, said that only one meeting was allowed with former Prime Minister, the Election Commission should issue an appropriate order to meet with the client. Member Sindh Nisar Durrani remonstrated that they can go to Adiala Jail for hearing during which they can also get all the facilities there.
Shoaib Shaheen said: “We are not being allowed to hold a rally, give us a level playing field. We have informed the Election Commission in writing about this issue”.
Later, the Election Commission adjourned the hearing of the cases till December 06.
