Imran Khan files petition to annul cypher case proceedings

Islamabad: The former-chairman of Pakistan Tehreek-e-Insaf (PTI) Imran Khan Tuesday challenged the cypher case in Islamabad High Court (IHC) and pleaded for acquittal by declaring the proceedings invalid.

In the petition filed by founder PTI Imran Khan, the stand was taken that the proceeding since November 23 till now is illegal.

The petition stated that earlier on December 12, the trial court rejected our petition against the cypher case. The trial court judge did not correctly interpret the word ‘complaint’ in Section 13 (2)(3) of the Official Secrets Act.

According to the petition, the interpretation of the word ‘complaint’ is clear in the law, which does not mention the report of the police officer. Section 4 (H) of the Criminal Procedure also defines the word ‘complaint’.

The text of the petition said that according to the law, complaints mean an oral or written plea before a magistrate on an allegation.

It was stated in the petition that the pending cypher case against Chairman PTI is being conducted on the basis of First Information Report (FIR) and police report.

The petition added that the Official Secrets Act is a special law which is different from the general law. Being a special law, legal procedure must be adopted while applying the Official Secrets Act.
