ECP-order to replace Justice Jahangiri declared invalid
IHC quashed the ECP’s order to replace Justice Tariq Mehmood Jahangiri
Islamabad: The Islamabad High Court (IHC) annulled the Election Commission of Pakistan's (ECP) order to replace Justice Tariq Mehmood Jahangiri.
According to the details, Justice Aamer Farooq of IHC pronounced the protected decision of the election appeals against the alleged rigging in the three constituencies of Islamabad.
Chief Justice IHC Aamer delivered a protected verdict and quashed the Election Commission's order to replace Justice Tariq Mehmood Jahangiri, and directed the ECP to remand the matter.
The IHC accepted the petition filed by three Pakistan Tehreek-e-Insaf (PTI) leaders Shoaib Shaheen, Amir Mughal and Ali Bukhari against the change of tribunal.
It is pertinent to note that Chief Justice Aamer Farooq had reserved the decision of the case after the arguments were completed.
On June 11, the ECP transferred their election petition to another tribunal on the request of three Members of National Assembly (MNAs) of Pakistan Muslim League-Nawaz (PML-N) to express ‘no confidence’ in the tribunal.
The four-member bench of the commission, headed by Chief Election Commissioner (CEC) Sikandar Sultan Raja, ruled in favor of PML-N’s Dr. Tariq Fazal Chaudhry, Anjum Aqeel and Raja Khurram Nawaz and said in its decision, the tribunal, headed by Islamabad High Court Justice Tariq Mehmood Jahangiri, exercised a jurisdiction which it did not legally possess.
