Lahore: The Lahore High Court (LHC) Wednesday dismissed former chief minister of Punjab Chaudhry Parvez Elahi's plea of habeas corpus as ineffective.
Disposing of the petition, the court said that contempt of court petition against the officers would continue separately, restraining Parvez Elahi from being arrested and detained in any case. However the Islamabad police arrested him on his way home.
The court said Sessions Judge Attock Asad Ali submitted his report yesterday in which it was stated that Pakistan Tehreek-e-Insaf (PTI) president Elahi was taken by Islamabad Police before the Sessions Judge reached Attock Jail.
Islamabad Chief Commissioner and Inspector General (IG) were summoned in person. Islamabad High Court (IHC) suspended the detention notification of Parvez Elahi.
According to Advocate General Islamabad, Parvez Elahi was arrested in a criminal case. He stated that IG Police Supreme Court and Chief Commissioner appeared in IHC.
The court further stated that show-cause notices were issued to the concerned officers for violating the court order and contempt proceedings will continue against these officers separately.
Chief Commissioner Islamabad violated the order of this court. A show cause notice of contempt of court is issued to him, the officers should file their response within seven days.
The court restrained Additional Advocate General Ghulam Sarwar Nahang from intervening.
It was also held by the court that Parvez's recovery appeal has become ineffective, hence the recovery application is disposed of.
Meanwhile, Qaisara Elahi's lawyers pleaded not to dispose of the application, on which the court said you can also challenge this court order.
