Justice Ijaz has submitted his resignation to the President, Dr. Arif Alvi to assent.
Islamabad: The Supreme Court (SC) of Pakistan’s judge Justice Ijazul Ahsan resigned from his position a day after Justice Mazahar Ali Naqvi left from office.
According to details, Justice Ijazul Ahsan was in the row to become the next Chief Justice of Pakistan (CJP) has rendered his demission making unparalleled times for the SC.
Justice Ijaz has submitted his resignation to the President, Dr. Arif Alvi to assent. He stated that he has had the prestige and prerogative of serving as a Judge and the Chief Justice of Lahore High Court (LHC), as well as the Judge of the Supreme Court of Pakistan.
Further Justice Ijaz said: “Therefore, I no more desire to continue as a Judge of SC. That’s why I, Justice Ijazul Ahsan, resign as a Judge of the Supreme Court of Pakistan in terms of Article 206(1) of the Constitution with instant effect, stunning many”.
No one was anticipating Justice Ijaz’s resignation. Now Justice Syed Mansoor Ali Shah will become the next CJ and work for more than three years. After his resignation, incumbent Chief Justice of Pakistan (CJP) Qazi Faez Isa's position has become brawny within the institution.
The filing of a presidential reference against Justice Qazi Faez, judicial politics have been at its height, and the SC has endured practically split into two camps.
Many lawyers think that Justice Ahsan should have tackled with the difficult situation. They stated that a judge should make himself ready to work under critical circumstances unlike Justice Naqvi, Ahsan might have obtained support from one section of lawyers.
It is to be noted that Justice Ahsan left after the Supreme Judicial Council (SJC) decided to proceed in Justice Naqvi's case in spite of his absence. Lawyers are stunned how the SJC is working against a resigned judge. According to a judicial order, assault proceedings could not be held against retired or resigned judges.
