SIC moves SC against 26th Constitutional Amendment
Petition requested that 26th Amendment be declared unconstitutional
Islamabad: The Sunni Ittehad Council (SIC) has challenged the 26th Constitutional Amendment in the Supreme Court.
The petition said that the 26th Constitutional Amendment is unconstitutional, illegal, and unenforceable.
The petition filed by the SIC in the Supreme Court stated that the 26th Amendment has eliminated the important features and fundamental values of the Constitution. It has also eliminated the independence of the judiciary, while the distribution of fundamental rights and powers has been affected.
The petition stated that the 26th Amendment is an attempt to change, repeal, or abolish the basic features of the Constitution. The amendment is illegal and unenforceable under Article 239 of the Constitution.
The petition requested that the 26th Amendment be declared unconstitutional, and its sections 7, 10, 14, 17, 21, and 27 should also be declared unconstitutional.
The petition further stated that the amendment was passed illegally and wrongly. All decisions, notifications, and appointments made through the 26th Constitutional Amendment should be declared null and void. An independent investigation should be conducted into the method of obtaining votes in favor of the 26th Amendment and an investigation should be conducted into the allegations of coercive measures and illegal methods used to pass the amendment.
The petition also requested that the Supreme Court (Practice and Procedure) Amendment Act, 2024, and the Supreme Court (Number of Judges) Amendment Act, 2024 be declared unconstitutional.
