Missing persons case: CM to be summoned if needed, PHC

Peshawar: The Peshawar High Court (PHC) judge Monday remarked during the hearing of the missing persons case that they will also summon the Chief Minister if necessary.

Chief Justice Ishtiaq Ibrahim of PHC heard the missing persons case, in which Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur could not appear.

During the hearing, Additional Advocate General told the court that the missing person was arrested in the case and is currently in jail.

The court inquired about the Chief Minister that he was summoned in this case. On which Advocate General Shah Faisal Atman Khel told the court that a sad incident had taken place in Bannu yesterday, it is its hearing today, therefore the chief minister is busy with that.

The Chief Justice Peshawar High Court remarked that some time ago your party was affected in the same way, today this is happening in your government, every day we see people crying in front of us. File a case against those who are guilty. We know some people take advantage of it but fix yourself.

The Chief Justice said that after being released on bail, people are re-arrested outside the jail. In the Asad Qaiser case, the court has declared that a person arrested in one case should be considered arrested in other cases as well.

The court inquired if the Provincial Safety Commission and District Safety Commission have been formed. It is in the Police Act, it has not been notified for seven years. The Advocate General replied that they are taking steps to notify it. The court said notifying the Safety Commission would solve many problems.

The Advocate General said that we are in a 100-meter race, and we have to do a lot of work. On which the Chief Justice remarked: “You were also in a 5000-marathon race earlier. Submitted the report of this case in 15 days”.

The court stated that if necessary, we will also summon the Chief Minister. Later, the court postponed the hearing of the case related to the missing persons.
