The petitioner filed an appeal in the Supreme Court against the decision of the High Court.


Islamabad: The Supreme Court Wednesday upheld the disqualification of former Member of National Assembly (MNA) Khadim Hussain of Pakistan Muslim League-Quaid (PML-Q) on the basis of a fake degree.
According to the details, a three-member bench headed by Chief Justice of Pakistan (CJP) Qazi Faez Isa conducted the hearing.
Chief Justice Qazi Faez Isa said, “It is better not to prosecute the case after the death of the petitioner, the case of fake degree ended with the death of the petitioner. We can hear the case if there is any criminal aspect of it”.
Lawyer Khawaja Haris stated that the family members of the decreased insist that the allegation of fake degree should be removed by hearing the case.
‘My client received all his education in the name of Muhammad Akhtar Khadim, he did politics in the name of Khadim Hussain and his identity card is also in the same name’, added the lawyer.
Justice Muhammad Ali Mazhar remarked that if the petitioner was alive, something could have been proved, how will the family members prove the correct name after death? As is the old rule, with death the actions of the deceased also cease.
The CJP asked the lawyer to show any affidavit or documents as evidence. If there is a position to change the name, then it is your responsibility to present the evidence.
It is pertinent to note that Mohammad Akhtar Khadim alias Khadim Hussain was elected from NA-188 in 2008. The High Court disqualified Mohammad Akhtar Khadim alias Khadim Hussain on the basis of fake BA degree.
The petitioner filed an appeal in the Supreme Court against the decision of the High Court.
