Islamabad: Supreme Court has allowed Pakistan Tehreek-e-Insaf’s (PTI) president Pervaiz Elahi to contest in the upcoming general election ahead on February 8, 2024.
According to the details, a three-member bench led by Justice Mansoor Ali Shah heard the appeal against the rejection of Pervaiz Elahi's nomination papers.
Elahi's lawyer Ehsan Khokhar argued that we do not want to delay the election, Pervaiz should be allowed to contest the election up to the extent of PP-32 Gujarat.
The court asked that how did you get access to 10 marla plot paper? The lawyer said that the 10 marla plot document was received from the Patwari. Justice Athar stated that do you want to say that the caretaker government is involved in this?
The court remarked that voters should not be deprived of their right to vote hence the returning officer's job is to facilitate and not to obstruct the elections, it is strange that all this is happening with the same political party, elections are meant to involve people, not to throw them out.
Justice Mansoor said that in Article 17 that no one can be prevented from election without valid reasons.
The court accepted Pervaiz Elahi's plea and annulled the decision to reject the nomination papers and directed to print Pervaiz Elahi's name and election symbol on the ballot paper.
However, PTI president Pervaiz Elahi has withdrawn from all other constituencies.
