SC refers reinstatement petitions of dismissed employees to Constitution Benches
Justice Ayesha Malik remarked that this case will be heard by main constitutional bench.
Islamabad: After the enactment of the 26th constitutional amendment, the Supreme Court sent the reinstatement petitions of the dismissed employees to the constitutional benches.
A three-member bench headed by Justice Mansoor Ali Shah heard the reinstatement petitions of the dismissed employees.
The lawyer petitioner Waseem Sajjad said that a peaceful life is the constitutional right of every citizen. Justice Mansoor Ali Shah remarked that there is a constitutional question in this case and the 26th Constitutional Amendment states that constitutional cases will be heard by constitutional benches which will be formed and decide the case.
Justice Ayesha Malik said in her remarks that this case will be heard by the main constitutional bench.
The Supreme Court remarked that cases of constitutional question in the context of the 26th Constitutional Amendment will be heard by the Constitution Benches, referring the petitions to the Constitution Benches.
It is pertinent to note that seven employees of the Ministry of Petroleum Natural Resources approached the Supreme Court against the decision of the High Court.
