Missing persons case: CM KP appears before PHC over summoning
Judge remarked that this is not a single case, there are other cases also in which people have been re-arrested after bail
Peshawar: Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur appeared in the court after being summoned by Peshawar High Court (PHC) on Monday in the case related to missing persons.
According to the details, Chief Justice PHC Ishtiaq Ibrahim heard the case of missing persons in which Chief Minister KP was summoned to appear in the court while Advocate General and Additional Chief Secretary also appeared in the court.
The Chief Justice asked Chief Minister KP that arrests are being made despite bail. There are court orders that no arrests will be made after bail. The families of missing persons come after us, to which the chief minister replied that he is against such matters.
Chief Justice Ishtiaq said that they should go to the Supreme Court for cancellation of bail, do not abduct people like this. This is not the first incident, it has happened again and again, they will not compromise on court orders.
The court stated that they would forcefully take action against the policemen now, Advocate General should submit the reply and CTD and police should look into the matter.
On this occasion, Chief Minister Ali Amin asked the court to give the focal person, 'We will make legislation together with the Advocate General'.
It is pertinent to note that the court had summoned KP CM today in the morning in the missing persons case.
During the hearing, the petitioner's counsel said that his client was picked up from the front of the jail despite being on bail, which is visible in the CCTV footage.
Chief Justice PHC Ishtiaq Ibrahim inquired if bail was granted in a case, how could someone be arrested from outside the jail, this is a violation of the court’s decision.
The Chief Justice remarked to call the Chief Minister of Khyber Pakhtunkhwa. ‘I am sitting, Ali Amin Gandapur should appear sometime by 5 o'clock, I am present in the court’.
Justice Ishtiaq Ibrahim stated that in the case of Asad Qaiser, the court has declared that after getting bail in one case, he cannot be arrested in another case. This case will not take even more than 10 minutes. Talk to the Chief Minister that he should come.
The Advocate General told the court that there was a meeting regarding law and order and therefore the Chief Minister is busy. On which the Chief Justice said that you should consult with him, I have to order today.
The Chief Justice remarked that this is not a single case, there are other cases also in which people have been re-arrested after being granted bail.
